1. Introduction
Welcome to ReserveBird.
These Terms and Conditions govern your access to and use of ReserveBird’s website, order forms, WhatsApp channels, social media pages, pickup points, delivery services, subscription plans, pre-order campaigns, and other services.
ReserveBird connects customers with verified farm products, including live birds, dressed/frozen poultry, eggs, and other farm produce. We may source products from our own farm operations, verified partner farms, processors, cold-chain partners, pickup point partners, and delivery partners.
By placing an order, making payment, subscribing to a plan, reserving a product, or using ReserveBird, you agree to these Terms and Conditions.
If you do not agree, please do not use ReserveBird.
2. Definitions
In these Terms:
“ReserveBird,” “we,” “us,” or “our” means ReserveBird and its authorised representatives.
“Customer,” “you,” or “your” means any person or organisation that uses ReserveBird or places an order.
“Product” means any item offered through ReserveBird, including live birds, dressed birds, frozen poultry, eggs, farm produce, or related items.
“Live Bird” means a bird supplied alive for pickup or delivery.
“Dressed Product” means a bird or other product that has been slaughtered, cleaned, packaged, chilled, or frozen.
“Pre-order” means an order placed before the product is ready for pickup or delivery.
“Reservation Fee” means a payment made to reserve a product or order slot.
“Subscription Plan” means a payment arrangement where a customer pays in instalments before the fulfilment date.
“Pickup Point” means a location where customers collect their orders.
“Delivery Partner” means a third party engaged to transport or deliver orders.
3. Nature of Our Service
ReserveBird may operate as:
- A seller of farm products
- A farm product aggregator
- A marketplace connecting customers to verified farms
- A fulfilment and logistics coordinator
- A processor, packaging coordinator, or cold-chain facilitator
- A pickup and delivery facilitator
Depending on the order, ReserveBird may fulfil directly or through partner farms, processors, pickup hubs, or delivery partners.
4. Product Availability
All products are subject to availability.
For pre-orders, estimated availability may depend on:
- Farm production cycle
- Bird growth and maturity
- Mortality or health issues
- Feed availability
- Weather conditions
- Transport availability
- Processing capacity
- Cold storage capacity
- Government restrictions or public safety issues
- Force majeure events
We will make reasonable efforts to fulfil confirmed orders, but we do not guarantee unlimited supply.
Where a product becomes unavailable, we may offer:
- A replacement product
- A different size/category
- A later fulfilment date
- Store credit
- Refund, where applicable
5. Product Descriptions and Weight Categories
We try to describe products as accurately as possible.
However, farm products, especially live birds and dressed poultry, may vary in:
- Size
- Weight
- Colour
- Appearance
- Final dressed weight
- Natural shape
- Packaging appearance
Where products are sold by category, such as standard, big, or jumbo, the category description will guide fulfilment.
For live birds, weight estimates may differ from final delivery weight due to natural variation, feeding, handling, stress, transportation, and timing.
For dressed/frozen products, final weight may be lower than live weight after slaughtering, cleaning, draining, chilling, and packaging.
6. Orders
An order may be placed through:
- Website
- Online form
- Social media
- Phone call
- Approved sales representative
- Corporate or bulk order channel
An order is not confirmed until we receive the required payment and issue confirmation through our approved channel.
We reserve the right to reject, cancel, or limit any order where:
- Payment is not confirmed
- Customer details are incomplete
- Delivery location is outside our service area
- Product is unavailable
- Fraud or suspicious activity is suspected
- The order violates these Terms
- Fulfilment is not commercially or operationally reasonable
7. Prices
Prices may vary based on:
- Product type
- Size/category
- Live or dressed/frozen option
- Processing requirement
- Packaging requirement
- Pickup or delivery option
- Delivery zone
- Order quantity
- Seasonal demand
- Feed and production costs
- Partner farm pricing
- Cold-chain or logistics costs
Prices displayed or quoted may change until payment is made and the order is confirmed.
For pre-orders or subscription plans, the price and payment schedule will be communicated before confirmation.
8. Payments
We may accept payments by:
- Bank transfer
- Payment link
- Card payment
- USSD
- POS
- Approved payment processor
- Other payment methods we approve
Customers are responsible for ensuring that payments are made using the correct account, payment link, or reference.
ReserveBird will not be responsible for payments made to unauthorised persons, fake accounts, impersonators, or incorrect payment details not provided by our official channels.
9. Reservation Fees and Deposits
For pre-orders, festive orders, live birds, bulk orders, or limited supply campaigns, we may require a reservation fee or deposit.
A reservation fee helps us:
- Reserve your product or slot
- Plan farm allocation
- Arrange feeding and production
- Schedule processing
- Secure delivery or pickup capacity
- Reduce unserious bookings
Reservation fees may be non-refundable or partly refundable depending on the refund policy, timing, and product type.
The specific terms attached to each reservation will be stated at the time of booking.
10. Subscription and Instalment Plans
ReserveBird may allow customers to pay gradually through a subscription or instalment plan.
Customers on a payment plan must follow the agreed payment schedule.
Failure to make payment on time may result in:
- Payment reminder
- Suspension of allocation
- Movement to a smaller product category
- Loss of priority delivery date
- Cancellation of reservation
- Application of cancellation charges
- Store credit instead of cash refund, where applicable
Orders on payment plans must be fully paid before pickup or delivery unless ReserveBird has expressly agreed otherwise in writing.
11. Full Payment Before Fulfilment
Unless otherwise agreed in writing, all orders must be fully paid before:
- Pickup
- Delivery
- Processing
- Dispatch
- Release to a customer or customer representative
ReserveBird reserves the right to withhold any product until full payment is confirmed.
12. Pickup Points
Customers may choose or be assigned a pickup point.
Customers must collect orders within the communicated pickup window.
At pickup, customers or their authorised representatives may be required to provide:
- Order ID
- Phone number
- Payment confirmation
- Valid identification where necessary
- OTP or pickup code where applicable
ReserveBird is not responsible for release of an order to a person who presents valid order details, pickup code, or authorisation provided by the customer.
13. Delivery
Delivery may be available in selected locations only.
Delivery times are estimates and may be affected by:
- Traffic
- Weather
- Road conditions
- Customer availability
- Security restrictions
- Vehicle breakdown
- Product handling requirements
- Cold-chain limitations
- High seasonal demand
- Government restrictions
Customers must provide accurate delivery information and be available during the delivery window.
If a customer is unavailable, unreachable, or provides incorrect details, additional delivery charges may apply.
14. Live Bird Delivery
Live bird delivery is subject to operational feasibility, animal handling requirements, traffic, safety, and location.
ReserveBird may refuse live bird door delivery where:
- The location is unsuitable
- Access is restricted
- Delivery may endanger the bird, staff, rider, driver, or public
- The delivery cost is excessive
- The customer is unavailable
- Local rules or estate restrictions prevent delivery
For live birds, customers should inspect the bird upon pickup or delivery.
Once a live bird is accepted by the customer or their representative, ReserveBird will not be responsible for subsequent injury, escape, death, mishandling, slaughtering issues, or storage conditions outside our control.
15. Dressed, Chilled, or Frozen Products
Dressed, chilled, or frozen products require proper handling.
Customers must ensure prompt collection, receipt, storage, refrigeration, or freezing after pickup or delivery.
ReserveBird will not be responsible for spoilage, thawing, contamination, or quality deterioration caused by:
- Delayed pickup by customer
- Customer not being available for delivery
- Incorrect delivery address
- Poor storage after delivery
- Failure to refrigerate or freeze promptly
- Tampering after delivery
- Customer transportation after pickup
Customers should inspect packaging upon receipt and report any issue immediately.
16. Customer Responsibilities
Customers agree to:
- Provide accurate order information
- Use correct payment channels
- Keep payment evidence
- Provide complete delivery or pickup details
- Be available during pickup or delivery windows
- Inspect products at pickup or delivery
- Follow storage and handling instructions
- Treat staff, drivers, pickup partners, and farm partners respectfully
- Avoid fraudulent claims, chargebacks, or misuse of our service
17. Corporate, Bulk, Estate, Church, and Group Orders
Bulk orders may have special terms, including:
- Minimum order quantity
- Deposit requirement
- Delivery schedule
- Dedicated pickup or delivery arrangement
- Processing and packaging requirements
- Written invoice
- Balance payment deadline
- Cancellation deadline
- Separate refund terms
Where group delivery is arranged, ReserveBird may deliver to one agreed contact person, estate representative, church representative, company representative, or group coordinator.
Once delivery is made to the approved group representative, distribution to individual members becomes the responsibility of that group unless otherwise agreed.
18. Partner Farms and Third-Party Providers
ReserveBird may work with partner farms, processors, cold rooms, pickup points, and delivery partners.
We make reasonable efforts to verify partners and maintain service standards, but some aspects of production, processing, storage, or delivery may depend on third parties.
ReserveBird may replace a partner farm or fulfilment partner where necessary to complete your order.
19. Food Safety and Handling
We aim to maintain reasonable food safety, hygiene, and handling standards.
Customers are responsible for safely storing, cooking, handling, and consuming products after pickup or delivery.
ReserveBird is not responsible for illness, spoilage, contamination, or loss caused by customer mishandling, delayed storage, improper cooking, or unsafe storage after receipt.
20. Promotions and Discounts
ReserveBird may offer promotions, discounts, referral rewards, early-bird pricing, or seasonal offers.
Promotions may be subject to:
- Availability
- Time limits
- Quantity limits
- Location limits
- Product category limits
- Payment deadlines
- Separate terms
We may modify, suspend, or withdraw any promotion at any time.
21. Prohibited Use
You must not use ReserveBird to:
- Commit fraud
- Place fake orders
- Abuse payment plans
- Harass staff or partners
- Provide false delivery information
- Resell products in a misleading way
- Impersonate another customer or representative
- Attempt unauthorised access to our systems
- Damage our brand, platform, partners, or customers
22. Complaints
Complaints should be made as soon as possible through our official support channel.
For product quality issues, customers may be required to provide:
- Order ID
- Photos or videos
- Time of pickup or delivery
- Description of the issue
- Packaging evidence where applicable
- Product condition at receipt
Delayed complaints may be harder to verify, especially for perishable products.
23. Limitation of Liability
To the maximum extent permitted by law, ReserveBird will not be liable for indirect, incidental, special, or consequential losses, including loss of profit, loss of business, emotional distress, or inconvenience arising from use of our service.
Our liability for any confirmed claim shall generally be limited to the amount paid for the affected product or service, unless applicable law requires otherwise.
24. Force Majeure
ReserveBird will not be liable for failure or delay caused by events beyond our reasonable control, including:
- Disease outbreak
- Farm mortality event
- Feed shortage
- Flooding
- Fire
- Road closure
- Fuel scarcity
- Strike
- Riot
- Government restriction
- Insecurity
- Internet/payment failure
- Transport disruption
- Extreme weather
- Cold-chain failure outside our control
- Any other event beyond reasonable control
Where possible, we will communicate alternatives such as rescheduling, replacement, store credit, or refund in line with our Refund Policy.
25. Intellectual Property
All ReserveBird names, logos, content, designs, images, order flows, text, graphics, and brand assets belong to ReserveBird or its licensors.
You may not copy, reproduce, use, or modify our brand assets without written permission.
26. Changes to These Terms
We may update these Terms and Conditions from time to time.
The updated version will be posted on our website or communicated through our official channels. Continued use of ReserveBird after changes are published means you accept the updated Terms.
27. Governing Law
These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria.
Any dispute arising from these Terms shall first be addressed through good-faith negotiation. Where resolution is not reached, the dispute may be referred to mediation, arbitration, or a court of competent jurisdiction in Nigeria, depending on the nature of the dispute.
